Ezzy Fit Lifetime Warranty
Composite Retaining Wall Sleepers, Fencing, and Building Products
IMPORTANT: THIS WARRANTY IS THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY EZZY FIT. BY ACCEPTING DELIVERY OF PRODUCTS, THE CUSTOMER AGREES TO BE BOUND BY THESE TERMS.
1. Warranty Coverage & Limitations
Ezzy Fit Pty Ltd ("Company") warrants to the original purchaser ("Customer") that its composite building products ("Materials") will be free from defects in materials and workmanship under normal use, subject to all terms and limitations herein.
1.1 Delivery Inspection & Return Obligations
The Customer must inspect all Materials immediately upon delivery/pickup. Any claims for defects (including bowing, chips, cracks, or other damage) must follow this process:
- Notify Ezzy Fit in writing within 24 hours of delivery/pickup
- Return all defective Materials to the original place of purchase at Customer's expense
- Provide photographic evidence and original proof of purchase
- Allow 5-7 business days for inspection and verification
WARNING: FAILURE TO RETURN DEFECTIVE MATERIALS OR REPORT ISSUES WITHIN 24 HOURS VOIDS ALL WARRANTY CLAIMS. EZZY FIT RESERVES THE RIGHT TO DENY CLAIMS FOR MATERIALS NOT RETURNED FOR INSPECTION.
1.2 Warranty Exclusions
This Warranty does not cover:
- Defects not reported within 24 hours of delivery/pickup
- Materials not returned for inspection
- Damage occurring after delivery but before installation
- Improper handling, storage, or transportation by Customer
- Cosmetic issues including fading or discoloration
- Installation by unapproved contractors
2. Legal Protections & Disclaimers
2.1 Limitation of Liability
IN NO EVENT SHALL EZZY FIT BE LIABLE FOR:
- Incidental, consequential, or punitive damages
- Labor costs for removal/reinstallation
- Transportation or freight charges
- Claims exceeding the original purchase price
2.2 Legal Compliance
This Warranty provides specific legal rights that vary by jurisdiction. Where prohibited, some exclusions may not apply.
3. Warranty Claims Process
3.1 Valid Claims
For claims unrelated to delivery defects, Customer must:
- Submit written notice within 30 days of defect discovery
- Provide proof of professional installation by licensed contractor
- Return defective materials for inspection (at Customer's expense)
- Allow 14 business days for claim processing
3.2 Remedies
At its sole discretion, Ezzy Fit may:
- Repair or replace defective Materials
- Issue credit for verified defects
- Deny improperly submitted claims
Note: Replacement materials may differ in color/texture from original purchase. Ezzy Fit is not responsible for matching existing installations.
4. General Provisions
4.1 Governing Law
This Warranty shall be governed by Queensland law. Any disputes must be filed in Queensland courts within 12 months of claim denial.
4.2 Entire Agreement
This document constitutes the entire agreement between Ezzy Fit and Customer regarding warranty coverage, superseding all prior agreements.
ACKNOWLEDGMENT: BY ACCEPTING DELIVERY, CUSTOMER ACKNOWLEDGES THEY HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS IN THEIR ENTIRETY, INCLUDING ALL LIMITATIONS AND EXCLUSIONS.
