ENTIRE AGREEMENT & EXCLUSIVE WARRANTY
THIS WARRANTY CONSTITUTES THE SOLE AND EXCLUSIVE WARRANTY PROVIDED BY EZZY FIT PTY LTD. BY ACCEPTING DELIVERY OF PRODUCTS, THE CUSTOMER IRREVOCABLY AGREES TO THESE TERMS, WAIVES ANY RIGHTS TO CLAIM INDIRECT OR CONSEQUENTIAL DAMAGES, AND ACKNOWLEDGES THAT NO REPRESENTATION OUTSIDE THIS DOCUMENT IS BINDING. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EZZY FIT DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Thank you for choosing Ezzy Fit. Our engineered composite products are manufactured to strict standards. This Lifetime Limited Warranty applies solely to manufacturing defects and strictly limits liability to replacement of faulty materials only. No claim for labour, installation, removal, or any other cost will be accepted.
1. Warranty Coverage (Strict Limits)
Ezzy Fit warrants composite products are free from manufacturing defects at time of delivery. This warranty:
Applies only to the original purchaser — non-transferable
Valid for lifetime of original installation (30 years from purchase date)
Covers replacement of defective products ONLY — no labour, no freight, no ancillary costs
ABSOLUTE EXCLUSION: Ezzy Fit will not provide labour, removal, reinstallation, transport, or in-house installation under any circumstance. No alternative remedies, damages, or compensation are payable.
2. Full Exclusion Clause
This warranty EXCLUDES and disclaims liability for:
Surface chalking, staining, mould, or efflorescence
Glue, adhesive, resin failures or joint separation
Warping, bowing, twisting, cracking, expansion/contraction due to heat, moisture, soil movement, subsidence, or ground pressure
Damage from misuse, incorrect installation, modification, improper storage or transport
Installation by unlicensed, unapproved, or non-compliant contractors
Impact, fire, vandalism, chemical exposure, flood, storm, or any natural disaster
Normal wear and tear, cosmetic imperfections, lack of maintenance or cleaning
WARRANTY VOID IF: Any product is altered, modified, cut improperly, or installed contrary to Ezzy Fit's published installation guidelines. Unauthorized site modifications void all coverage.
3. Strict Claim Procedure
Mandatory conditions precedent to any claim:
Inspect all products immediately upon delivery — written notice to Ezzy Fit within 24 hours of delivery if defect is visible.
Return defective product to original point of purchase at customer's sole cost and risk.
Provide clear photographic evidence, original proof of purchase, and certified proof of professional installation by a licensed contractor.
FAILURE TO COMPLY STRICTLY WITH THESE PROCEDURES VOIDS ALL WARRANTY RIGHTS. No claim will be processed without full compliance.
4. Ezzy Fit's Sole Obligation
If a valid manufacturing defect is confirmed (at Ezzy Fit's sole discretion), Ezzy Fit will, as its only liability, replace the defective product FOB point of origin. The customer bears all freight, handling, removal, reinstallation, and any associated costs.
Expressly excluded: labour, transport, re-installation, colour matching, texture variations, loss of profits, loss of use, property damage, or any indirect, incidental, special or consequential damages.
5. Cap on Liability & Indemnity
To the fullest extent permitted by law (including the Australian Consumer Law):
Ezzy Fit's total aggregate liability is strictly limited to the original purchase price of the defective product.
Under no circumstances will Ezzy Fit be liable for property damage, personal injury, economic loss, loss of profits, or any consequential loss arising from use, installation, or failure of products.
Customer agrees to indemnify and hold harmless Ezzy Fit against all claims, suits, damages, and legal costs arising from improper installation, misuse, or failure to follow guidelines.
All products are supplied "as is" for installation, and the customer assumes full responsibility for site conditions, handling, and structural performance.
LIMITATION OF LIABILITY — AUSTRALIAN CONSUMER LAW (ACL) COMPLIANCE
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to a replacement or refund and compensation for reasonably foreseeable loss. However, where permitted by the ACL, Ezzy Fit's liability for any breach of consumer guarantee is strictly limited to, at our option, replacement of the goods or payment of the cost of replacement. This warranty explicitly excludes any liability for consequential loss, property damage, loss of profits, installation costs, removal costs, or legal expenses beyond the purchase price. To the maximum extent permissible, all implied warranties are excluded.
WARRANTY CLAIM RECORD (RETAIN FOR YOUR FILES)
IMPORTANT: To validate any future warranty claim, you must provide proof of professional installation by a licensed contractor and original purchase receipt. The information above helps establish eligibility. Warranty is void if installation was performed by an unlicensed or unapproved party.
6. Governing Law & Jurisdiction
This warranty is governed exclusively by the laws of Queensland, Australia. Any dispute must be commenced within 12 months of the alleged defect and exclusively in the courts of Queensland. Customer waives any right to class action, jury trial, or joinder of claims.
7. No Waiver & Severability
Failure to enforce any term does not constitute a waiver. If any provision is deemed unenforceable, the remainder remains in full force.
8. Acknowledgment & Acceptance
By accepting delivery, installation, or use of any Ezzy Fit product, the customer irrevocably acknowledges they have read, understood, and agreed to all terms, limitations, exclusions, and liability caps.
FINAL BINDING ACKNOWLEDGMENT
BY ACCEPTING DELIVERY OF EZZY FIT PRODUCTS, THE CUSTOMER AGREES THAT THIS WARRANTY REPRESENTS THE COMPLETE, EXCLUSIVE, AND FINAL STATEMENT OF WARRANTY. THE CUSTOMER WAIVES ANY RIGHT TO CLAIM CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES, AND RELEASES EZZY FIT FROM ALL LIABILITY BEYOND REPLACEMENT OF DEFECTIVE PRODUCTS AS STATED. NO ORAL OR WRITTEN REPRESENTATION OUTSIDE THIS CERTIFICATE IS BINDING.
This warranty is governed by the laws of Queensland, Australia. Any litigation shall be filed exclusively in Queensland courts. Ezzy Fit's liability is capped at the purchase price of the defective product. Nothing in this warranty excludes rights under the ACL that cannot be limited, however to the extent permissible, all liability for consequential loss is excluded.
