EZZY FIT RETURN & LIABILITY POLICY

1. No Returns for Change of Mind or Incorrect Orders

We do not accept returns, refunds, exchanges, or credits for:

  • Change of mind
  • Incorrectly ordered products (wrong quantities, measurements, sizes, specifications, or colours)
  • Surplus or unused materials
  • Finding the product cheaper elsewhere
  • Deciding you no longer need the product
⚠️ All sales are final once processed and dispatched. Double-check your order before confirming.
2. Your Rights Under Australian Consumer Law (ACL)

This Return Policy does not exclude your rights under the ACL. You are entitled to a refund, replacement, or repair if a product has:

  • A manufacturing fault or defect
  • Damage upon delivery
  • A significant difference from what was described
  • A failure to be fit for its intended purpose
⚠️ CRITICAL LIABILITY EXCLUSION: Ezzy Fit accepts no liability whatsoever for installation outcomes, including but not limited to wall damage, improper fit, water ingress, structural issues, or personal injury. This exclusion applies even where Ezzy Fit personnel carry out the installation. The customer assumes all risk associated with installation and use of products.
3. Claim Timeframes – Strict Deadlines

4. How to Lodge a Claim – Mandatory Steps

To make any claim, you must strictly comply with all of the following:

  1. Notify us in writing within the timeframes above
  2. Provide your order number and proof of purchase
  3. Provide clear photographic and video evidence of the fault
  4. Provide proof of professional installation by a licensed contractor (if required — see section 6)
  5. Return the defective product to our nominated address

5. What Happens Next Determined solely by Ezzy Fit

Major Failure

Product unsafe, significantly different, or cannot be repaired

You choose: refund or replacement

Minor Failure

Small issue that can be easily repaired

We choose: repair or replacement

If we confirm a valid manufacturing defect (and only after strict compliance with all claim steps), we will provide a prepaid shipping label for return of the defective product. No other shipping, freight, handling, removal, reinstallation, or labour costs are covered — regardless of who installed the product.

6. Installation & Reinstallation – No Liability, Even if Ezzy Fit Installs critical

Ezzy Fit sells products only. By default, you install them. However, even in the rare event that Ezzy Fit (or its agents) agrees to perform installation services, the following applies:

  • Ezzy Fit disclaims all liability for any damage, loss, defect, or injury arising from or related to the installation process, including but not limited to: damage to walls, surfaces, studs, electrical wiring, plumbing, personal injury, incorrect fitting, misalignment, or failure of the installed product.
  • The customer assumes all risk of installation, whether performed by Ezzy Fit, a subcontractor, or the customer.
  • If we replace a faulty product under a valid manufacturing defect claim: we send you a free replacement (delivery included). You are solely responsible for removing the original product and reinstalling the replacement — this includes all labour, tools, site preparation, wall repairs, handyman fees, and professional installer costs. Ezzy Fit never pays for removal, reinstallation, or labour, even if Ezzy Fit originally installed the product.
🚫 ABSOLUTE WAIVER OF INSTALLATION LIABILITY: To the maximum extent permitted by Australian Consumer Law and general law, Ezzy Fit Pty Ltd is not liable for any direct, indirect, special, or consequential loss, damage, or expense arising from or connected with the installation, use, or inability to use any product — including instances where Ezzy Fit employees, contractors, or agents performed the installation. The customer acknowledges that installation is provided "as is" and at the customer's own risk.
7. Change of Mind – Not Accepted repeated for clarity

We do not offer refunds, exchanges, or credits for change of mind, ordering the wrong size, finding it cheaper elsewhere, or deciding you no longer need the product.

🔔 Acknowledgment of No Liability (Even When Ezzy Fit Installs)

By purchasing and using Ezzy Fit products, you agree that under no circumstances shall Ezzy Fit Pty Ltd, its directors, employees, or contractors be held liable for any loss, damage, claim, or expense arising from the installation, removal, reinstallation, or performance of any product, regardless of whether Ezzy Fit personnel performed the installation. This exclusion applies to all forms of liability, whether in contract, tort (including negligence), statute, or otherwise. Your sole remedy for any product defect is limited to replacement of the product as outlined in section 5, and no claim for labour, installation costs, property damage, or consequential loss will be accepted.

Important reminder: This policy is effective as of 13 June 2025 and supersedes all prior policies. By placing an order with Ezzy Fit, you acknowledge that you have read, understood, and agreed to these terms, including the complete waiver of liability for installation (even if Ezzy Fit installed the product). All claim deadlines are strictly enforced.
